The European Court of justice sends EU patent back to the drawing board
Research Europe magazine has published on March 24th, 2011 a paper by Gérald Sédrati-Dinet, voluntary counsel at April on patents, on the recent events concerning patents in Europe.
The article was written and published on April website before the European Parliament gave its approval to the talks on a future regulation of a unitary patent under an enhanced cooperation procedure. After the vote at the European , the article was rewritten and finally published on March 24th 2011.
Although the article was rewritten before the European Court of Justice delivered its opinion on the topic, the criticisms exposed in this article are still valid and will be of tremendous importance for the ongoing debates on the role of European Patent Office in the future unitary patent system.
